## SEC. 3085 STREAMLINING PROJECT BIOSHIELD PROCUREMENT Section 319F-2(c) of the Public Health Service Act (42 U.S.C. 247d-6b(c)) is amended— ####
(1)in paragraph (4)(A)(ii), by striking “make a recommendation under paragraph
(6)that the special reserve fund as defined in subsection
(h)be made available for the procurement of such countermeasure” and inserting “and subject to the availability of appropriations, make available the special reserve fund as defined in subsection
(h)for procurement of such countermeasure, as applicable”; ####
(2)in paragraph (6)— #####
(A)by striking subparagraphs (A), (B), and (E); #####
(B)by redesignating subparagraphs
(C)and
(D)as subparagraphs
(A)and (B), respectively; #####
(C)by amending subparagraph (A), as so redesignated, to read as follows: > > ##### “(A) Notice to appropriate congressional committees > > The Secretary shall notify the Committee on Appropriations and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives of each decision to make available the special reserve fund as defined in subsection
(h)for procurement of a security countermeasure, including, where available, the number of, the nature of, and other information concerning potential suppliers of such countermeasure, and whether other potential suppliers of the same or similar countermeasures were considered and rejected for procurement under this section and the reasons for each such rejection.” > ; and #####
(D)in the heading, by striking “Recommendation for president’s approval” and inserting “Recommendations for procurement”; and ####
(3)in paragraph (7)— #####
(A)by striking subparagraphs
(A)and
(B)and inserting the following: > > ##### “(A) Payments from special reserve fund > > The special reserve fund as defined in subsection
(h)shall be available for payments made by the Secretary to a vendor for procurement of a security countermeasure in accordance with the provisions of this paragraph.” > ; and #####
(B)by redesignating subparagraph
(C)as subparagraph (B).
