## Sec. 196 ###
(a)Notwithstanding any other provision of this Act, in addition to the amount otherwise provided by section 101 for “Environmental Protection Agency—State and Tribal Assistance Grants”, there is appropriated $100,000,000 for an additional amount for fiscal year 2017, to remain available until expended, for making capitalization grants for the Drinking Water State Revolving Funds under section 1452 of the Safe Drinking Water Act pursuant to section 2201 of the Water and Waste Act of 2016. ###
(b)The last proviso of paragraph
(1)under the heading “Environmental Protection Agency—State and Tribal Assistance Grants” in division G of Public Law 114–113 shall be applied to amounts made available by this section by substituting for “only where such debt was incurred on or after the date of enactment of this Act” the following: “where such debt was incurred on or after the date of enactment of this Act, or where such debt was incurred prior to the date of enactment if the State, with concurrence from the Administrator, determines that such funds could be used to help address a threat to public health from heightened exposure to lead in drinking water or if a Federal or State emergency declaration has been issued due to a threat to public health from heightened exposure to lead in a municipal drinking water supply before the date of enactment of this Act: *Provided further*, That in a State in which such an emergency declaration has been issued, the State may use more than 20 percent of the funds made available under this title to the State for Drinking Water State Revolving Fund capitalization grants to provide additional subsidy to eligible recipients”.
