Notwithstanding sections 101 and 102, within amounts provided for “Department of Defense—Operation and Maintenance, Defense-Wide” and “Department of Defense—Research, Development, Test and Evaluation, Defense-Wide”, except for amounts designated for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced Budget and Emergency Deficit Control Act of 1985, the Secretary of Defense may develop, replace, and sustain Federal Government security and suitability background investigation information technology system requirements of the Office of Personnel Management at a rate for operations of $95,000,000.
