## SEC. 560 PROHIBITION ON RECEIPT OF UNEMPLOYMENT INSURANCE WHILE RECEIVING POST-9/11 EDUCATION ASSISTANCE ###
(a)Effect of Receipt of Post-9/11 Education Assistance Section 8525(b) of title 5, United States Code, is amended— ####
(1)in the matter preceding paragraph (1), by striking “he receives” and inserting “the individual receives”; ####
(2)in paragraph (1), by striking “or” after the semicolon; ####
(3)by redesignating paragraph
(2)as paragraph (3); and ####
(4)by inserting after paragraph
(1)the following new paragraph (2): > > #### “(2) > > except in the case of an individual described in subsection (a), an educational assistance allowance under chapter 33 of title 38; or” > . ###
(b)Exception Section 8525 of title 5, United States Code, is amended by inserting before subsection
(b)the following new subsection: > > ### “(a) > > Subsection (b)(2) does not apply to an individual who— > > > #### “(1) > > is otherwise entitled to compensation under this subchapter; > > > #### “(2) > > is described in section 3311(b) of title 38; > > > #### “(3) > > is not receiving retired pay under title 10; and > > > #### “(4) > > was discharged or released from service in the Armed Forces or the Commissioned Corps of the National Oceanic and Atmospheric Administration (including through a reduction in force) under honorable conditions, but did not voluntarily separate from such service.” > .
