## SEC. 17 CONSTRUCTION **[**[49 U.S.C. 1301 note](/us/usc/t49/s1301)**]** Nothing in this Act may be construed to affect any suit commenced by or against the Surface Transportation Board, or any proceeding or challenge pending before the Surface Transportation Board, before the date of the enactment of this Act.
