## SEC. 221 FIELDING OF BALLISTIC MISSILE DEFENSE CAPABILITIES Upon approval by the Secretary of Defense, funds authorized to be appropriated for fiscal years 2007 and 2008 for research, development, test, and evaluation for the Missile Defense Agency may be used for the development and fielding of ballistic missile defense capabilities.
