## SEC. 318 PAYMENT TO ENVIRONMENTAL PROTECTION AGENCY OF STIPULATED PENALTIES IN CONNECTION WITH JACKSON PARK HOUSING COMPLEX, WASHINGTON ###
(a)Authority To Transfer Funds ####
(1)Transfer amount Using funds described in subsection
(b)and notwithstanding section 2215 of title 10, United States Code, the Secretary of the Navy may transfer not more than $45,000 to the Hazardous Substance Superfund Jackson Park Housing Complex, Washington, special account. ####
(2)Purpose of transfer The payment under paragraph
(1)is to pay a stipulated penalty assessed by the Environmental Protection Agency on October 7, 2009, against the Jackson Park Housing Complex, Washington, for the failure by the Navy to submit a draft Final Remedial Investigation/Feasibility Study for the Jackson Park Housing Complex Operable Unit (OU-3T-JPHC) in accordance with the requirements of the Interagency Agreement (Administrative Docket No. CERCLA-10-2005-0023). ###
(b)Source of Funds Any payment under subsection
(a)shall be made using funds authorized to be appropriated by section 301 for operation and maintenance for Environmental Restoration, Navy. ###
(c)Use of Funds The amount transferred under subsection
(a)shall be used by the Environmental Protection Agency to pay the penalty described under paragraph
(2)of such subsection.
