## SEC. 246 REPORT ON INCREASED BUDGET ITEMS ###
(a)Report ####
(1)In general The Secretary of Defense shall submit to the congressional defense committees a report describing the contract award process for each contract described in subsection
(b)for which the Secretary will obligate funds authorized for a program element described in subsection (c). In the case of funds that are not yet obligated for any such contract by the end of fiscal year 2012, the Secretary shall describe the process planned for the award of such a contract. ####
(2)Submission The Secretary shall submit the report required by paragraph
(1)not later than December 31, 2012. ###
(b)Contract Described For purposes of subsection (a), a contract described in this subsection is a contract awarded using procedures other than competitive procedures pursuant to the exceptions set forth in section 2304(c) of title 10, United States Code, or any other exceptions provided in law or regulation. ###
(c)Program Element Described ####
(1)For purposes of subsection (a), a program element described in this subsection is a program element funded— #####
(A)with amounts authorized to be appropriated by section 201; and #####
(B)in a total amount that is more than the amount requested for such program element by the President in the budget submitted to Congress under section 1105 of title 31, United States Code, for fiscal year 2012. ####
(2)For purposes of paragraph (1)(B), the total amount referred to in such paragraph does not include funds transferred into such program element that were included elsewhere in the budget referred to in such paragraph. ## Subtitle E Other Matters
