## SEC. 31304 CORPORATE RESPONSIBILITY FOR NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION REPORTS ###
(a)In General Section 30166 of title 49, United States Code, is amended by adding at the end the following: > > ### “(o) Corporate Responsibility for Reports > > > #### “(1) In general > > The Secretary may promulgate rules requiring a senior official responsible for safety in any company submitting information to the Secretary in response to a request for information in a safety defect or compliance investigation under this chapter to certify that— > > > ##### “(A) > > the signing official has reviewed the submission; and > > > ##### “(B) > > based on the official’s knowledge, the submission does not— > > > ###### “(i) > > contain any untrue statement of a material fact; or > > > ###### “(ii) > > omit to state a material fact necessary in order to make the statements made not misleading, in light of the circumstances under which such statements were made. > > > #### “(2) Notice > > The certification requirements of this section shall be clearly stated on any request for information under paragraph (1).” > . ###
(b)Civil Penalty Section 30165(a) of title 49, United States Code, is amended— ####
(1)in paragraph (3), by striking “A person” and inserting “Except as provided in paragraph (4), a person”; and ####
(2)by adding at the end the following: > > #### “(4) False or misleading reports > > A person who knowingly and willfully submits materially false or misleading information to the Secretary, after certifying the same information as accurate under the certification process established pursuant to section 30166(o), shall be subject to a civil penalty of not more than $5,000 per day. The maximum penalty under this paragraph for a related series of daily violations is $1,000,000.” > .
