## SEC. 1317 CATEGORICAL EXCLUSION FOR PROJECTS OF LIMITED FEDERAL ASSISTANCE **[**[23 U.S.C. 109 note](/us/usc/t23/s109)**]** Not later than 180 days after the date of enactment of this Act, the Secretary shall— ####
(1)designate as an action categorically excluded from the requirements relating to environmental assessments or environmental impact statements under section 1508.4 of title 40, Code of Federal Regulations, and section 771.117(c) of title 23, Code of Federal Regulations, any project— #####
(A)that receives less than $6,000,000 (as adjusted annually by the Secretary to reflect any increases in the Consumer Price Index prepared by the Department of Labor) of Federal funds; or #####
(B)with a total estimated cost of not more than $35,000,000 (as adjusted annually by the Secretary to reflect any increases in the Consumer Price Index prepared by the Department of Labor) and Federal funds comprising less than 15 percent of the total estimated project cost; and ####
(2)not later than 150 days after the date of enactment of this Act, promulgate regulations to carry out paragraph (1).
