It is a Class 1 misdemeanor for a nonresident to transport bait and biological specimens into the state, possess bait or biological specimens within the state, or sell bait and biological specimen animals within the state without a nonresident wholesale bait dealer license or in violation of the conditions of the license or the rules of the Game, Fish and Parks Commission.
The Department of Game, Fish and Parks may issue any nonresident a nonresident wholesale bait dealer license, if the home state of the nonresident dealer provides a like opportunity to South Dakota residents to be licensed in that state. The license permits the licensee to transport bait and biological specimens into the state, possess bait and biological specimens within the state, and sell bait and biological specimen animals within the state to any retail, wholesale or export bait dealer licensed under the provisions of this chapter.
The licensee shall comply with the rules adopted pursuant to § 41-2-18 by the Game, Fish and Parks Commission to protect and perpetuate the bait and biological specimen animal resources of the state.
