37-5B-43. Civil penalty.

The director may impose a civil penalty against a person named in an order issued pursuant to subdivisions
(1)to (3), inclusive, and subdivision 37-5B-41(6). The amount of the civil penalty may not exceed five thousand dollars for each act or omission that constitutes the basis for issuing the order. The civil penalty may only be imposed:
(1)Following an opportunity for a hearing pursuant to § 37-5B-44 if the notice delivered to all named persons includes notice of the director's authority to impose a civil penalty under this section; or
(2)As part of an order issued pursuant to subdivisions
(1)to (3), inclusive and subdivision 37-5B-41(6), if the order is stipulated to by each person subject to the civil penalty.
Any civil penalty collected pursuant to this section shall be deposited into the state general fund.
