36-11A-11. Out-of-state distributor--License--Application--Violation as felony.

No out - of - state wholesale drug distributor may conduct business in this state without first obtaining a license from the board and paying the license fee set by the board. Application for an out - of - state wholesale drug distributor license under this section shall be made on a form provided by the board. Each person acting as a principal or agent for an out - of - state wholesale drug distributor to sell or distribute drugs in this state shall obtain a license unless the distributor has obtained a license pursuant to this chapter.
Out - of - state wholesale drug distributors may obtain the license required by this chapter on the basis of reciprocity if the out - of - state wholesale drug distributor possesses a valid license granted by another state pursuant to standards comparable to those in this state and the other state extends reciprocal treatment under its laws to wholesale drug distributors of this state.
Any person who violates this section is guilty of a Class 6 felony.
