34-36-4. Promulgation of rules.

For the purpose of implementing this chapter, the Department of Public Safety may adopt reasonable rules to protect the health and safety of persons from fire, explosion, and like emergencies. Such rules shall be promulgated in accordance with chapter 1-26 in the following areas:
(1)Definitions;
(2)The licensing of manufacturers, importers, and dealers of explosive materials;
(3)Establishment of permit classes and requirements;
(4)The issuance of permits;
(5)Denial or revocation of permits;
(6)The conduct of business by licensees and operations by permittees;
(7)The records and reports required of licensees and permittees;
(8)The storage and transportation of explosive material;
(9)Exemptions;
(10)Alternate methods of procedures, emergency variations from requirements; and
(11)Establishment of license and permit fees.
