If it is determined that a lodging establishment, campground, food service, or mobile food service establishment has not secured a license pursuant to § 34-18-10 , the secretary shall notify the owner of such establishment. If the owner refuses or fails to comply with the provisions of § 34-18-10 within fourteen calendar days after notification, the secretary shall, subject to the requirements of chapter 1-26 , issue a closure order to the owner of the establishment until such time as the owner complies with the licensure requirements.
If the establishment or campground continues to operate after a closure order is issued, the secretary may refer the matter to the appropriate state's attorney for criminal proceedings or the attorney general's office for injunctive relief.
