BILLING CODE 8011-01-P SECURITIES AND EXCHANGE COMMISSION [Release No. 34-95843; File No. SR-MEMX-2022-20] Self-Regulatory Organizations; MEMX LLC; Notice of Withdrawal of a Proposed Rule Change To Update Exchange Rule 13.4(a) Regarding the Exchange's Usage of Data Feeds September 20, 2022. On July 26, 2022, MEMX LLC (“MEMX”) filed with the Securities and Exchange Commission (“Commission”), pursuant to Section 19(b)(1) of the Securities Exchange Act of 1934 1 and Rule 19b-4 thereunder, 2 a proposed rule change to update Exchange Rule 13.4(a) regarding the sources of data that the Exchange utilizes for the handling, execution and routing of orders, as well as for surveillance necessary to monitor compliance with applicable securities laws and Exchange rules, with respect to certain market centers.
The filing was immediately effective upon filing with the Commission pursuant to Section 19(b)(3)(A) of the Act 3 and Rule 19b-4(f)(6) thereunder. 4 The proposed rule change was published for comment in the **Federal Register** on August 4, 2022. 5 On September 19, 2022, MEMX withdrew the proposed rule change (SR-MEMX-2022-20). 1 15 U.S.C. 78s(b)(1). 2 17 CFR 240.19b-4. 3 15 U.S.C. 78s(b)(3)(A). 4 17 CFR 240.19b-4(f)(6). In addition, Rule 19b-4(f)(6)(iii) requires a self-regulatory organization to give the Commission written notice of its intent to file the proposed rule change, along with a brief description and text of the proposed rule change, at least five business days prior to the date of filing of the proposed rule change, or such shorter time as designated by the Commission.
