BILLING CODE 4410-15-P DEPARTMENT OF JUSTICE Notice of Lodging of Consent Decree Under the Clean Air Act Notice is hereby given that on July 13, 2010, a proposed Consent Decree in *United States* v. *Edgeboro Disposal, Inc., et al.,* Civil Action No. 3:10-cv-03541-FLW-TJB, was filed with the United States District Court for the District of New Jersey. In this action, the United States sought penalties and injunctive relief for the Defendants' violations of the Clean Air Act, 42 U.S.C. 7411 * et seq.,* and the New Jersey Air Pollution Control Act, N.J.S.A. 26:2C-1 *et seq.,* at the Edgeboro landfill in East Brunswick, New Jersey.
To resolve the United States' claims, the Defendants will pay a penalty of $750,000 to the United States and New Jersey, and shall upgrade the Edgeboro Landfill Gas Collection and Control System, and operate that system in compliance with regulations promulgated pursuant to the Clean Air Act. The Department of Justice will receive for a period of thirty
(30)days from the date of this publication comments relating to the Consent Decree.
