BILLING CODE 9110-04-P ENVIRONMENTAL PROTECTION AGENCY 40 CFR Part 52 [EPA-R04-OAR-2010-0150-201009(b); FRL-9138-8] Approval and Promulgation of Implementation Plans: Tennessee; Visibility Impairment Prevention for Federal Class I Areas; Removal of Federally Promulgated Provisions AGENCY: Environmental Protection Agency (EPA). ACTION: Proposed rule. SUMMARY: EPA is proposing to remedy an inadvertent omission in the Tennessee State Implementation Plan

EPA approved Tennessee's visibility rules addressing new source review on July 18, 1996, and a plan addressing monitoring and reporting of visibility on July 2, 1997. EPA is proposing to correct this omission in this rulemaking. This action is being taken pursuant to section 110 of the Clean Air Act. In the Final Rules Section of this **Federal Register** , EPA is approving the State's SIP revision as a direct final rule without prior proposal because the Agency views this as a noncontroversial submittal and anticipates no adverse comments. If no adverse comments are received in response to this rule, no further activity is contemplated.
