SUPPLEMENTARY INFORMATION: Background Hydroxyurea is used in the treatment of cancer, sickle cell disease, and thalassemia. It is the only treatment for sickle cell disease used in children, aside from blood transfusion and, in severe cases, bone marrow transplantation. Hydroxyurea may be used in the treatment of children and adults with sickle cell disease for an extended period of time or for repeated cycles of therapy. Treatment with hydroxyurea may be associated with cytotoxic and myelosuppressive effects and hydroxyurea is mutagenic. Hydroxyurea is FDA-approved for use in adults with sickle cell anemia to reduce the frequency of moderate to severe painful crises and the need for blood transfusions. CERHR selected hydroxyurea for evaluation because of:
(1)Increasing use in the treatment of sickle cell disease in children and adults,
(2)knowledge that it inhibits DNA synthesis and is cytotoxic, and
(3)published evidence of reproductive and developmental toxicity in rodents. On January 24-26, 2007, CERHR convened an expert panel to conduct an evaluation of the potential reproductive and developmental toxicities of hydroxyurea. The expert panel report was released for public comment on February 26, 2007 ( **Federal Register** Vol. 72, No. 37, pp. 8384-8385). Following this public comment period, CERHR staff prepared the draft NTP Brief for Hydroxyurea that provides in plain language: • Background information on the substance(s). • Findings of the expert panel. • Discussion of any relevant data available after the expert panel meeting. • NTP's conclusions on the potential for the substance to cause adverse reproductive and/or developmental effects in exposed humans. Upon finalization, the NTP Brief for Hydroxyurea will be included in the CERHR Monograph for Hydroxyurea. The draft NTP Brief for Hydroxyurea and related background materials, including the hydroxyurea expert panel report and previously received public comments, are available on the CERHR Web site ( *http://cerhr.niehs.nih.gov;* see “Hydroxyurea” under “CERHR Reports & Monographs”). Request for Comments The NTP invites written public comments on the draft NTP Brief for Hydroxyurea. Any comments received will be posted on the CERHR Web site and considered during the peer review and finalization of the NTP Brief for Hydroxyurea. Proposed Project Possession, Use, and Transfer of Select Agents and Toxins (OMB Control No. 0920-0576)—Extension—Division of Select Agents and Toxins (DSAT), Coordinating Office for Terrorism Preparedness and Emergency Response (COTPER), Centers for Disease Control and Prevention (CDC). Background and Brief Description The Public Health Security and Bioterrorism Preparedness and Response Act of 2002, Subtitle A of Public Law 107-188 (42 U.S.C. 262a), requires the United States Department of Health and Human Services
(HHS)to regulate the possession, use, and transfer of biological agents or toxins (i.e., select agents and toxins) that could pose a severe threat to public health and safety. The Agricultural Bioterrorism Protection Act of 2002, Subtitle B of Public Law 107-188 (7 U.S.C. 8401), requires the United States Department of Agriculture
(USDA)to regulate the possession, use, and transfer of biological agents or toxins (i.e., select agents and toxins) that could pose a severe threat to animal or plant health, or animal or plant products. In accordance with these Acts, HHS and USDA promulgated regulations requiring entities to register with the CDC or the Animal and Plant Health Inspection Service (APHIS) if they possess, use, or transfer a select agent or toxin (42 CFR part 73, 7 CFR part 331, and 9 CFR part 121). CDC and APHIS coordinate regulatory activities for those agents that would be regulated by both agencies (“overlap” select agents). Accordingly, CDC and APHIS adopted an identical system to collect information for the possession, use, and transfer of select agents and toxins. CDC is requesting continued OMB approval to collect this information through the use of five separate forms. These forms are:
(1)Application for Registration,
(2)Request to Transfer Select Agent or Toxin,
(3)Report of Theft, Loss, or Release of Select Agent and Toxin,
(4)Report of Identification of Select Agent or Toxin, and
(5)Request for Exemption. The Application for Registration (42 CFR, 73.7(d)) will be used by entities to register with CDC. The Application for Registration requests facility information; a list of select agents or toxins in use, possession, or for transfer by the entity; characterization of the select agent or toxin; and laboratory information. Estimated average time to complete this form is 3 hours, 45 minutes for an entity with one principal investigator working with the select agent or toxin. Based on the data obtained from the 264 entities registered with CDC (this number excludes registered federal government entities), there are approximately 2 principal investigators for each registered entity. For new applications submitted to the CDC since the last submission, CDC estimates based on the information obtained from the database that 5 applications will be submitted from entities wishing to register with CDC to possess, use or transfer select agents and toxins on an annual basis. We have used these figures to calculate the burden for this section. Estimated burden for the Application for Registration is 375 hours. Entities may amend their registration (42 CFR, 73.7(h)(1)) if any changes occur in the information submitted to CDC. To apply for an amendment to a certificate of registration, an entity must obtain the relevant portion of the application package and submit the information requested in the package to CDC. Estimated time to amend a registration package is 1 hour. Based on the data regarding amendments received from registered entities since the last submission, CDC estimates 5 amendment request to entity's certificate of registration will be received on an annual basis. The Request to Transfer Select Agent or Toxin form (42 CFR 73.16) will be used by entities requesting transfer of a select agent or toxin to their facility. CDC in conjunction with APHIS has revised the Request to Transfer Select Agent or Toxin form by requiring the recipient to submit the initial request, be notified by the sender of the expected shipment date, and verify if the shipment did not occur. Estimated average time to complete this form is 1 hour, 30 minutes. Based on data regarding the transfer requests received since the last submission, CDC estimates 4 transfer requests submitted per registered entity on an annual basis. The Report of Theft, Loss, or Release of Select Agent and Toxin form (42 CFR 73.19(a)(b)) must be completed by entities whenever there is theft, loss, or release of a select agent or toxin. Estimated average time to complete this form is 1 hour. Based on data regarding the reports received since the last submission, CDC estimates that 60 reports per respondent will be received on an annual basis. The Report of Identification of Select Agent or Toxin form (42 CFR 73.5(a)(b) and 73.6(a)(b)) will be used by clinical and diagnostic laboratories to notify CDC that select agents or toxins identified as the result of diagnostic or proficiency testing have been disposed of in a proper manner. In addition, the form will be used by Federal law enforcement agencies to report the seizure and final disposition of select agents and toxins. CDC in conjunction with APHIS has revised the Report of Identification of Select Agent or Toxin form to ensure duplicate reports are not submitted by requesting the entity that makes the final identification report the select agents or toxins identified as the result of diagnostic or verification testing. Estimated average time to complete this form is 1 hour. Based on data regarding the reports received since the last submission, CDC estimates that 10 reports per respondent will be received on an annual basis. The Request for Exemption form (42 CFR 73.5 (d)(e) and 73.6 (d)(e)) will be used by entities that are using an investigational product that are, bear, or contain select agents or toxins or in cases of public health emergency. Estimated average time to complete this form is 1 hour. Based on data regarding the requests received since the last submission, CDC estimates that 5 requests per respondent will be received on an annual basis. In addition to the standardized forms, this regulation also outlines situations in which an entity must notify or may make a request of the HHS Secretary in writing. An entity may apply to the HHS Secretary for an expedited review of an individual by the Attorney General (42 CFR 73.10(e)). To apply for this expedited review, an entity must submit a request in writing to the HHS Secretary establishing the need for such action. The estimated time to gather the information and submit this request is 30 minutes. CDC has not developed standardized forms to use in the above situations. Rather, the entity should provide the information as requested in the appropriate section of the regulation. An entity may also apply to the HHS Secretary for an exclusion of an attenuated strain of a select agent or toxin that does not pose a severe threat to public health and safety (42 CFR 73.3(e)(1) and 73.4(e)(1)). The estimated time to gather the information and submit this request is 1 hour. As part of the requirements of the Responsible Official, the Responsible Official is required to conduct regular inspections (at least annually) of the laboratory where select agents or toxins are stored. Results of these self-inspections must be documented (42 CFR 73.9(a)(5)). CDC estimates, that, on average, such documentation will take 1 hour. As part of the training requirements of this regulation, the entity is required to record the identity of the individual trained, the date of training, and the means used to verify that the employee understood the training (42 CFR 73.15(c)). Estimated time for this documentation is 2 hours per principal investigator. An individual or entity may request administrative review of a decision denying or revoking certification of registration or an individual may appeal a denial of access approval (42 CFR 73.20). This request must be made in writing and within 30 calendar days after the adverse decision. This request should include a statement of the factual basis for the review. CDC estimates the time to prepare and submit such a request is 4 hours. An entity must implement a system to ensure that certain records and databases are accurate and that the authenticity of records may be verified (42 CFR 73.17(b)). The time to implement such a system is estimated to average 4 hours. Prior to issuance of a certificate of registration, CDC inspects entities to ensure compliance with this regulation (42 CFR 73.18). As part of the inspection process, the entity may need to respond to written requests from CDC. CDC estimates the time to prepare and submit a response for the inspection is 8 hours. To estimate the burden, we use the total number of registered entities since each entity will be inspected at least once during the course of their registration. Proposed Project Work Organization Predictors of Depression in Women—Reinstatement—The National Institute for Occupational Safety and Health (NIOSH), Centers for Disease Control and Prevention (CDC). Background and Brief Description Depression is a costly and debilitating occupational health problem. Research has indicated that the costs to an organization of treatment for depression can rival those for heart disease, and major and minor depressive disorders which have been found to be associated with more disability days than other types of health diagnoses. This may be of particular relevance for working women. Various national and international studies indicate that women in developed countries experience depression at up to twice the rate of men. Studies that have examined this gender difference have focused on social, personality, and genetic explanations while few have explored factors in the workplace that may contribute to the gender differential. Examples of workplace factors that may contribute to depression among women include: Additive workplace and home responsibilities, lack of control and authority, and low paying and low status jobs. Additionally, women are much more likely to face various types of discrimination in the workplace than men, ranging from harassment to inequalities in hiring and promotional opportunities, and these types of stressors have been strongly linked with psychological distress and other negative health outcomes. On the positive side, organizations that are judged by their employees to value diversity and employee development engender lower levels of employee stress, and those that enforce policies against discrimination have more committed employees. Such organizational practices and policies may be beneficial for employee mental health, particularly the mental health of women. This research focuses on the following questions:
(1)Which work organization factors are most predictive of depression in women, and
(2)are there measurable work organization factors that confer protection against depression in women employees? The research uses a repeated measures, prospective design with data collection at three points (baseline and 1-year and 2-year follow-ups). A 45-minute survey is being administered by telephone to 314 women and men at 16 different organizations. The survey contains questions about traditional job stressors (e.g., changes in workload, social support, work roles), stressors not traditionally examined, but which may be linked with depressive symptoms among women (e.g., roles and responsibilities outside of the workplace, discrimination, career issues) depression symptoms, and company policies, programs and practices. In our previous collection (2002), one Human Resource
(HR)representative at each company was also surveyed about company policies, programs and practices. No HR representatives will be contacted for this survey. Analyses will determine which work organization factors are linked with depressive symptoms and what effect the organizational practices/policies of interest have on depression. Findings from this prospective study will also help target future intervention efforts to reduce occupationally-related depression in women workers. This study is being renewed in order to finish data collection. There will be no cost to respondents other than their time. Proposed Project Respiratory Protective Devices—42 CFR 84—Regulation—(0920-0109)—Reinstatement—National Institute for Occupational Safety and Health (NIOSH), Centers for Disease Control and Prevention (CDC). Background and Brief Description The regulatory authority for the National Institute for Occupational Safety and Health (NIOSH) certification program for respiratory protective devices is found in the Mine Safety and Health Amendments Act of 1977 (30 U.S.C. 577a, 651 et seq., and 657(g)) and the Occupational Safety and Health Act of 1970 (30 U.S.C. 3, 5, 7, 811, 842(h), 844). These regulations provide the basis for the performance tests and the criteria to respirator manufacturers who submit respirators for testing and certification to be NIOSH-approved. Respirators are used by millions of American construction workers, miners, painters, asbestos removal workers, fabric mill workers, and fire fighters. Improved testing requirements have benefits industrial workers, and health care workers implementing the current CDC *Guidelines for Preventing the Transmission of Tuberculosis* . Recent developments have provided approvals for self-contained breathing apparatus (SCBA), Air-Purifying respirators, Powered Air-Purifying
(PAPR)and Air-Purifying Escape respirators for use by fire fighters and other first responders to potential terrorist attacks. NIOSH, in accordance with 42 CFR 84:
(1)Issues certificates of approval for respirators meeting specified construction, performance, and protection requirements;
(2)establishes procedures and requirements to be met in filing applications for approval;
(3)specifies minimum requirements and methods to be employed by NIOSH and by applicants in conducting inspections, examinations, and tests to determine effectiveness of respirators;
(4)establishes a schedule of fees to be charged applicants for testing and certification, and
(5)establishes approval labeling requirements. Information is collected from respirator manufacturers such as; contact information, type of respirator, quality assurance plan, and draft labels, as specified in the regulation. The estimated annualized burden hours are 78,776. There is no cost to the respondents other than their time. Proposed Project Evaluation of State Nutrition and Physical Activity Programs to Prevent Obesity and Other Chronic Diseases—Reinstatement—National Center for Chronic Disease Prevention and Health Promotion (NCCDHP), Centers for Disease Control and Prevention (CDC). Background and Brief Description In order to prevent and control obesity and other chronic diseases, CDC established state-based nutrition and physical activity programs to support the development and implementation of nutrition and physical activity interventions, particularly through population-based strategies such as policy-level changes, environmental supports and the social marketing process. The overall programmatic goal is to promote population-based behavior change, such as increased physical activity and better dietary habits, thus leading to a reduction in the prevalence of obesity, and ultimately to a reduction in the prevalence of chronic diseases. CDC funding for state nutrition and physical activity programs may be used for capacity building, collaboration, planning, monitoring the burden of obesity, intervention, and evaluation. CDC has previously collected information to evaluate the State Nutrition and Physical Activity Programs to Prevent Obesity and Other Chronic Diseases (OMB no. 0920-0669, exp. date 01/31/2008). The evaluation was designed to focus on recipient activities as outlined in the original funding announcement. CDC proposes to reinstate the information collection with minor changes to the data collection instrument, in response to recommendations from the respondents, CDC staff, and the evaluation contractor. Changes are designed to streamline and clarify questions and response options. The project will continue to be conducted over a 3-year period. Information will be collected twice per year via a web-based data collection system. There are no costs to the respondents other than their time. The total estimated annualized burden hours are 672. Proposed Project Environmental Health Specialists Network (EHS-NET) Program—New—National Center for Environmental Health (NCEH), Centers for Disease Control and Prevention (CDC). Background and Brief Description The purpose of this project is to conduct research focused on identifying the environmental causes of food and waterborne illness and improving environmental public health practice. This research program is conducted by the Environmental Health Specialists Network (EHS-Net), a collaborative project of CDC, the U.S. Food and Drug Administration (FDA), the U.S. Department of Agriculture (USDA), the U.S. Environmental Protection Agency (U.S. EPA), and nine states (California, Connecticut, Georgia, Iowa, New York, Minnesota, Oregon, Rhode Island, and Tennessee). The network consists of environmental health professionals, epidemiologists, and laboratorians. EHS-Net plans to conduct a maximum of 35 applied research projects per year. These research projects will focus on identifying and understanding environmental factors associated with food and waterborne illness, such as poor food and water handling practices. These projects will also focus on evaluation of food and water safety regulatory programs. Data collection for these projects may involve:
(1)Surveys,
(2)observations, and
(3)food, water, and environmental sampling. Data may be collected from:
(1)Retail food establishments, where the majority of foodborne illness outbreaks originate,
(2)public and non-public water systems, representing possible sources of waterborne illness, and
(3)environmental public health program regulators (food and water), who are responsible for food and water safety. There will be up to 3,900 respondents for retail food service workers; 2,200 respondents for water system operators; and 4,275 respondents for environmental public health program (food and water) regulators. Each respondent will respond only once and the average burden per response will be approximately 90 minutes. The maximum total annual burden for all EHS-Net projects is expected to be approximately 20,625 hours. There is no cost to the respondents other than their time. The CFSP lays the groundwork for a system of coordinated, integrated, and culturally relevant family services for the subsequent five years (45 CFR 1357.15(a)(1)). The CFSP outlines initiatives and activities the State, Tribe or Territory will carry out in administering programs and services to promote the safety, permanency, and well-being of children and families. By June 30 of each year, States, Territories, and Tribes are also required to submit an Annual Progress and Services Report
(APSR)and a financial report called the CFS-101. The APSR is a yearly report that discusses progress made by a State, Territory or Tribe in accomplishing the goals and objectives cited in its CFSP (45 CFR 1357.16(a)). The APSR contains new and updated information about service needs and organizational capacities throughout the five-year plan period. The CFS-101 has three parts. Part I is an annual budget request for the upcoming fiscal year. Part II includes a summary of planned expenditures by program area for the upcoming fiscal year, the estimated number of individuals or families to be served, and the geographical service area. Part III includes actual expenditures by program area, numbers of families and individuals served by program area, and the geographic areas served for the last complete fiscal year. The Child and Family Services Improvement Act of 2006 amended Title IV-B, subparts 1 and 2, adding a number of requirements that affect reporting through the APSR and the CFS-101. Of particular note, the law added a provision requiring States (excluding Tribes and Territories) to report data on caseworker visits (section 424(e) of the Act). States must provide annual data on 1) the percentage of children in foster care under the responsibility of the State who were visited on a monthly basis by the caseworker handling the case of the child; and 2) the percentage of the visits that occurred in the residence of the child. In addition, by June 30, 2008, States must set target percentages and establish strategies to meet the goal that; by October 1, 2011; at least 90 percent of the children in foster care are visited by their caseworkers on a monthly basis and that the majority of these visits occur in the residence of the child (section 424(e)(2)(A) of the Act). *Respondents:* States, Territories, and Tribes must complete the CFSP, APSR, and CFS-101, Parts I, II, and III. Tribes and Territories are not required to meet the monthly caseworker visits reporting requirement of the APSR. There are approximately 223 Tribal entities that are eligible for title IV-B funding. There are 52 States and Territories that must complete the CFSP, APSR, and CFS-101. There are a total of 275 possible respondents. SUPPLEMENTARY INFORMATION: The BLM is considering issuing a coal lease as a result of an April 6, 2005, application made by Antelope Coal Company (Antelope) to lease the Federal coal in the West Antelope II coal tract. This tract is located in Converse and Campbell counties and is near the Antelope Mine, approximately 50 miles north of Douglas, Wyoming. The DEIS analyzes and discloses to the public the direct, indirect, and cumulative environmental impacts of issuing a Federal coal lease in the Wyoming portion of the Powder River Basin. A copy of the DEIS has been sent to affected Federal, State, and local government agencies; persons and entities identified as potentially being affected by a decision to lease the Federal coal in this tract; and persons who indicated to the BLM that they wished to receive a copy of the DEIS. The purpose of the public hearing is to solicit comments on the DEIS, on the proposed competitive sale of the West Antelope II coal tract, and comments on the FMV and MER of the Federal coal. Antelope originally applied for the tract in accordance with 43 CFR part 3425 in order to extend the life of the existing Antelope Mine. The Board of Commissioners of Converse County, Wyoming; the Wyoming Department of Environmental Quality Air Quality Division and Land Quality Division; the Office of Surface Mining Reclamation and Enforcement; and the U.S. Forest Service are cooperating agencies in the preparation of the DEIS. The DEIS analyzes leasing the West Antelope II coal tract as the Proposed Action. Under the Proposed Action, a competitive sale would be held and a lease issued for Federal coal in the tract as applied for by Antelope. As part of the coal leasing process, the BLM is evaluating an additional alternative that would add up to 2,200.6 adjacent acres of Federal coal to the tract to assure the maximum economic recovery of coal, to avoid isolating or bypassing marketable coal, or to prompt competitive interest in the unleased Federal coal for this area. These additional lands, located in T. 40 N., R. 71 W. and T. 41 N., R. 71 W., could potentially add another 65 million tons of in-place Federal coal to the West Antelope II LBA tract. The alternate tract configuration that BLM is evaluating is described and analyzed as a separate alternative in the DEIS. Under this alternative, a competitive sale would be held and a lease issued for Federal coal lands included in a tract modified by the BLM. The DEIS also analyzes the alternative of rejecting the application to lease Federal coal as the No Action Alternative. The Proposed Action and alternatives being considered in the DEIS are in conformance with the Approved Resource Management Plan for Public Lands Administered by the Bureau of Land Management Buffalo Field Office (2001), the Bureau of Land Management Casper Field Office Resource Management Plan (2007), and the USDA-Forest Service Land and Resource Management Plan for the Thunder Basin National Grassland (2002). The Department's Notice of affirmative determination was published in the **Federal Register** on December 19, 2007 (72 FR 71962). A certification for Trade Adjustment Assistance
(TAA)and Alternative Trade Adjustment Assistance
(ATAA)applicable to workers at the subject firm was issued on October 21, 2005 and remained valid until October 21, 2007 (TA-W-58,039). The certification was based on the Department's finding that the subject workers produced rayon staple fiber and that increased imports of articles like or directly competitive with those produced by the subject firm contributed importantly to subject firm sales or production declines and to workers' separations. On August 24, 2007, a TAA/ATAA petition (TA-W-62,049) was filed by a company official on behalf of workers and former workers of the subject firm. The petition was withdrawn on August 29, 2007. The Department issued a Notice of Termination of Investigation on September 4, 2007. On October 22, 2007, a TAA/ATAA petition was filed by a company official on behalf of workers and former workers of the subject firm (TA-W-62,333). The petition stated that the subject firm produced rayon staple fiber, the subject firm closed on September 26, 2005, and that “Five
(5)employees remain in the employment of the company to assist the bankruptcy trustee. The remaining employees will be laid off in the next 6-9 months.” The initial determination, issued on November 13, 2007, stated that the workers performed maintenance of a closed fiber production facility, that the workers no longer support a firm or appropriate subdivision that produces an article domestically, and, thus, the subject worker group cannot be considered import impacted or affected by a shift in production of an article. The request for reconsideration stated that the subject firm ceased operations in September 2005, that a Chapter 7 bankruptcy (dissolution) trustee was appointed in November 2005, and that the trustee retained the service of several employees to assist in the settlement of the corporation's estate. The request also stated that, with regards to petition TA-W-58,039, the Department “accurately designated the loss of those permanent jobs to be the result of increased imports activity” and asserts that workers covered by petition TA-W-62,333 should be eligible to apply for TAA and ATAA on the same basis (increased imports). In order to be certified as eligible to apply for adjustment assistance under section 223 of the Trade Act of 1974, the petitioning group must work for a firm or appropriate subdivision that produces an article domestically, and there must be a relationship between the workers' work and the article produced by the workers' firm or appropriate subdivision. Under section 223(a) of the Trade Act of 1974, as amended, TAA certification may be made if the following criteria are met: Section (a)(2)(A)— A. A significant number or proportion of the workers in such workers' firm, or an appropriate subdivision of the firm, have become totally or partially separated, or are threatened to become totally or partially separated; *and* B. The sales or production, or both, of such firm or subdivision have decreased absolutely; *and* C. Increased imports of articles like or directly competitive with articles produced by such firm or subdivision have contributed importantly to such workers' separation or threat of separation and to the decline in sales or production of such firm or subdivision; or Section (a)(2)(B)— A. A significant number or proportion of the workers in such workers' firm, or an appropriate subdivision of the firm, have become totally or partially separated, or are threatened to become totally or partially separated; *and* B. There has been a shift in production by such workers' firm or subdivision to a foreign country of articles like or directly competitive with articles which are produced by such firm or subdivision; *and* C. One of the following must be satisfied: 1. the country to which the workers' firm has shifted production of the articles is a party to a free trade agreement with the United States; *or* 2. the country to which the workers' firm has shifted production of the articles is a beneficiary country under the Andean Trade Preference Act, African Growth and Opportunity Act, or the Caribbean Basin Economic Recovery Act; *or* 3. there has been or is likely to be an increase in imports of articles that are like or directly competitive with articles which are or were produced by such firm or subdivision. Because the request for reconsideration asserts that the workers covered by TA-W-62,333 should be certified for TAA and ATAA for the same reason that the workers covered by TA-W-58,039 were certified (increased imports), the Department investigated whether the criteria set forth in section (a)(2)(A) were met. The Section (a)(2)(A) requires that “imports of articles like or directly competitive with articles produced by such firm or subdivision have increased” and increased imports must have “contributed importantly to such workers' separation or threat of separation and to the decline in sales or production of such firm or subdivision.” To be certified based on increased imports, the Department must find that increased imports is a cause that contributed importantly to a two-part effect: the workers' separation or threat of separation, and the decline in subject firm sales or production. Because the cause must precede the effect, it follows that increased imports must occur before or coincide with the subject firm's sales or production decline, and, that without that effect, causality cannot be established. “Increased imports,” defined at 29 CFR 97.2, means “that imports have increased either absolutely or relative to domestic production compared to a representative base period. The representative base period shall be one year consisting of the four quarters immediately preceding the date which is twelve months prior to the date of the petition.” Because the date of the petition is October 22, 2007, the relevant period (the twelve months prior to the petition date) is October 2006 through September 2007 and the representative base period is October 2005 through September 2006. Therefore, for there to be increased imports, imports during October 2006 through September 2007 would have to increase compared to the period of October 2005 through September 2006. During the reconsideration investigation, the Department confirmed that the subject firm ceased operation and closed permanently in September 2005, that the subject firm filed for Chapter 11 bankruptcy (reorganization) on September 29, 2005, and that the case was converted to Chapter 7 bankruptcy (dissolution) on November 21, 2005. Because there were no subject firm sales or production since September 2005, the Department finds that there could not have been any decline in sales or production at the subject firm during the relevant period. Consequently, increased imports could not have “contributed importantly to * * * the decline in sales or production of” the subject firm. Accordingly, the subject workers cannot be certified under section 222(a)(2)(A). Further, the Department finds that because the subject firm permanently closed in September 2005, there was not production that could have shifted to a foreign country. Accordingly, the subject workers cannot be certified under section 222(a)(2)(B). Although the request for reconsideration did not allege that the subject workers were adversely affected as secondary workers (workers of a firm that supply component parts to a TAA-certified company or finished or assembled for a TAA-certified company), the Department expanded the investigation to determine whether they would be eligible to apply for TAA on this basis. Such a certification, under section 223(b)(2), must be based in the certification of a primary firm. Prior to the closure in September 2005, the subject firm produced a final article (rayon staple fiber) and, therefore, neither supplied component parts to other companies nor finished or assembled an article for other companies. Even if the subject firm did engage in such activity, the activity occurred prior to September 2005, and, therefore, occurred prior to the relevant period and cannot be a basis for certification. Accordingly, the subject workers cannot be certified under section 223(b)(2). In order for the Department to issue a certification of eligibility to apply for Alternative Trade Adjustment Assistance (ATAA), the subject worker group must be certified eligible to apply for TAA. Since the petitioning worker group is denied eligibility to apply for TAA, the subject workers cannot be certified eligible for ATAA. Conclusion After careful reconsideration, I affirm the original notice of negative determination of eligibility to apply for worker adjustment assistance for workers and former workers of Liberty Fibers Corporation, Lowland, Tennessee.
