BILLING CODE 3510-22-S 69 239 Tuesday, December 14, 2004 Presidential Documents Part VII The President Presidential Determination No. 2005-08 of November 29, 2004—Waiving Prohibition on United States Military Assistance with Respect to Burundi, Guyana, and Liberia Presidential Determination No. 2005-09 of December 6, 2004—Waiver of Restrictions on Assistance to Russia under the Cooperative Threat Reduction Act of 1993 and Title V of the FREEDOM Support Act Memorandum of December 8, 2004—Delegation of Certain Reporting Authority Memorandum of December 8, 2004—Delegation of Certain Reporting Authority Memorandum of December 8, 2004—Delegation of Certain Reporting Authority Memorandum of December 8, 2004—Delegation of Certain Reporting Authority Title 3— The President Presidential Determination No. 2005-08 of November 29, 2004 Waiving Prohibition on United States Military Assistance with Respect to Burundi, Guyana, and Liberia Memorandum for the Secretary of State Consistent with the authority vested in me by section 2007 of the American Servicemembers' Protection Act of 2002 (the “Act”), title II of Public Law 107-206 (22 U.S.C. 7421 *et seq* .), I hereby: • Determine that Burundi, Guyana, and Liberia have each entered into an agreement with the United States pursuant to Article 98 of the Rome Statute preventing the International Criminal Court from proceeding against U.S. personnel present in such countries; and • Waive the prohibition of section 2007(a) of the Act with respect to these countries for as long as such agreement remains in force.
