ACTION: Affirmation of interim rule as final rule. SUMMARY: We are adopting as a final rule, without change, an interim rule that amended the citrus canker regulations by removing a portion of Hillsborough County, FL, from the list of quarantined areas. The regulations require that an area be free from citrus canker for a period of at least 2 years before it may be removed from the list of quarantined areas. Surveys have shown that the quarantined area in Hillsborough County, FL, has been free of citrus canker since December 1999. The interim rule removed restrictions on the interstate movement of regulated articles from that portion of Hillsborough County, FL. EFFECTIVE DATE: The interim rule became effective on March 21, 2002. SUPPLEMENTARY INFORMATION: Background In an interim rule effective and published in the **Federal Register** on March 21, 2002 (67 FR 13083-13084, Docket No. 02-018-1), we amended the citrus canker regulations in 7 CFR part 301 by removing a portion of Hillsborough County, FL, from the list of quarantined areas in § 301.75-4(a). The regulations require that an area be free from citrus canker for a period of at least 2 years before it may be removed from the list of quarantined areas, and surveys have shown that the quarantined area in Hillsborough County, FL, has been free of citrus canker since December 1999. Therefore, the interim rule removed restrictions on the interstate movement of regulated articles from that area. Comments on the interim rule were required to be received on or before May 20, 2002. We did not receive any comments. Therefore, for the reason given in the interim rule, we are adopting the interim rule as a final rule. This action also affirms the information contained in the interim rule concerning Executive Order 12866 and the Regulatory Flexibility Act, Executive Orders 12372 and 12988, and the Paperwork Reduction Act. Further, for this action, the Office of Management and Budget has waived its review under Executive Order 12866.
