§ 7101. Licensing transient retail business.
(a)Regulation.-- A township may, by ordinance, regulate and license transient retail merchants engaged in any transient retail business within the township. The ordinance may prohibit the commencement or transaction of any transient retail business until or unless the license required by the ordinance has been obtained from the township by the individual, firm or corporation desiring to commence the transient retail business. The ordinance may be enforced by a penalty, not to exceed $300, for a violation of the provisions of the ordinance and may provide for other means of enforcement.
(b)Fees.-- The board of commissioners may establish license fees for businesses regulated under this section. The license fees shall bear a reasonable relationship to the cost of administering the ordinance and regulating, inspecting and supervising each business.
(c)Construction.-- Nothing contained in this section shall be construed to apply to any of the following:
(1)farmers selling their own produce;
(2)a person selling personal property, donated by the owners, if the proceeds of the sale are to be applied to a charitable or philanthropic purpose; or
(3)a manufacturer or producer in the sale of bread and bakery products, meat and meat products or milk and milk products.
