§ 5519. Streets in or near public parks.
(a)Creation, relocation or alteration of parks.-- The board of commissioners may contract with the Commonwealth, a county or a municipal corporation owning and operating parks inside the township to establish, relocate, alter or vacate public streets inside or contiguous to those parks. The board of commissioners shall take no action with respect to the public streets without the written consent and agreement of the Commonwealth, county or municipal corporation owning and operating the parks. A street, when altered or relocated under this section, shall be maintained and repaired the same as other township streets.
(b)Ordinance required.-- The agreement shall be adopted by ordinance and within 30 days the street shall be a public street of the township.
(c)Petition of injury.-- The owner of any land through which a public street may be located or relocated may apply by petition to the court of common pleas, specifying the injury that has been sustained by reason of the relocation of the public street. The proceedings relative to the assessment and payment of damages of the landowner shall be in accordance with 26 Pa.C.S. (relating to eminent domain).
