§ 3902. Land for armory purposes.
(a)Armories.-- Except as provided under subsection (b), the board of commissioners may acquire, by purchase, gift or eminent domain, land for the use of the Pennsylvania National Guard, to be conveyed to the Commonwealth in order to assist the State Armory Board in the erection of armories.
(b)Limitation.-- The board of commissioners may not exercise the power granted under subsection
(a)to take church property or other actual place of regularly stated religious worship, a graveyard, cemetery or dwelling house or the curtilage of church property or other actual place of regularly stated religious worship, graveyard, cemetery or dwelling house in the actual occupancy of the owner.
