§ 7178. Failure to serve in a township.
(a)Scope of section.-- This section applies to an individual in a township if all of the following circumstances exist:
(1)The individual is elected or appointed a constable.
(2)The individual has a freehold estate worth at least $1,000.
(3)The individual fails to:
(i)serve; or
(ii)appoint a deputy to serve.
(b)Fine.-- Except as set forth in subsection (c), an individual under subsection
(a)shall be fined $40 for the use of the appropriate township.
(c)Exception.-- Subsection
(b)shall not apply to an individual who:
(1)has served personally or by deputy in the office of constable of the same township within 15 years of election or appointment; or
(2)has paid a fine under subsection
(b)within 15 years of election or appointment.
