§70-6-149.6. Insurance indemnification not a waiver of defenses.

Unless otherwise provided by law, the existence of any policy of insurance indemnifying a school or an education employee against liability for damages is not a waiver of any defense otherwise available to the educational entity or its employees in the defense of the claim. Added by Laws 2013, 1st Ex. Sess., c. 7, § 7, emerg. eff. Sept. 10, 2013. NOTE: Text formerly resided under repealed Title 70, § 6-145, which was derived from Laws 2009, c. 228, § 80, which was held unconstitutional by the Oklahoma Supreme Court in the case of Douglas v. Cox Retirement Properties, Inc., 2013 OK 37, 302 P.2d 789 (Okla. 2013).
