A. For purposes of this act, partial hospitalization programs, day treatment programs and day hospital programs mean nonresidential
settings in which school-age children are placed for psychiatric or psychological treatment which precludes their attendance at a regular public school.
B. No later than August 15, 1994, the State Board of Education shall establish standards for on-site educational services provided in partial hospitalization programs, day treatment programs, and day hospital programs for persons between the ages of three
(3)and twenty-one
(21)years of age. For minors who are persons requiring psychiatric treatment as defined by Title 43A of the Oklahoma Statutes, on-site educational services shall be provided beginning on the eleventh day of admission. The standards shall address all areas of education including teacher certification requirements, number of hours taught, adequacy of facilities, and educational plans including plans for transition into regular school setting.
C. No facility listed in subsection A of this section shall be licensed pursuant to the provisions of this act unless the facility meets the standards for educational services established by the State Board of Education.
D. The State Board of Education shall promulgate rules to implement the provisions of this act. Added by Laws 1994, c. 378, § 2, eff. July 1, 1994. Amended by Laws 2014, c. 90, § 2, eff. July 1, 2014.
