investigation of books, records and persons – Examination or investigation fees.
A. The Administrator of the Department of Consumer Credit may promulgate administrative rules in accordance with the Administrative Procedures Act for the enforcement of this act.
B. To assure compliance with this act, the Administrator may examine the relevant business, books and records of any licensee. Further, for the purposes of discovering violations of this act and determining whether persons are subject to this act, the Administrator may examine or investigate persons licensed under this act and persons reasonably suspected by the Administrator of conducting business that requires a license under this act by exercising authority that includes, but is not limited to, the power to summon witnesses and examine them under oath or affirmation and to compel the production of books and records that may be relevant to the examination or investigation.
C. A licensee or unlicensed person subject to the licensing requirements of this act, that is examined or investigated in accordance with this act, shall pay to the Administrator the reasonable and actual expenses of the investigation or examination, including travel expenses, in addition to the supervision fee of Seven Hundred Dollars ($700.00). Such reasonable and actual expenses shall include a fee of Fifty Dollars ($50.00) per hour for exams lasting more than eight
(8)hours. In-state travel expenses shall comply with such limitations and allowances as provided by the State Travel Reimbursement Act as found in Section 500.1 et seq. of Title 74 of the Oklahoma Statutes. The expenses shall be payable in addition to all other fees, taxes and costs required by law. Added by Laws 2019, c. 89, § 16, eff. Nov. 1, 2019.
