§22-928.1. Excess punishment to be disregarded by court.

If the jury assesses a punishment, whether of imprisonment or fine, greater than the highest limit declared by law for the offense of which they convict the defendant, the court shall disregard the excess and pronounce sentence and render judgment according to the highest limit prescribed by law in the particular case. Added by Laws 1999, 1st Ex.Sess., c. 5, § 441, eff. July 1, 1999.
