Where the jury finds a verdict of guilty, and fails to agree on the punishment to be inflicted, or does not declare such punishment
by their verdict, the court shall assess and declare the punishment and render the judgment accordingly. Added by Laws 1999, 1st Ex.Sess., c. 5, § 440, eff. July 1, 1999.
