§18-441-1213. Denial of reinstatement - Appeal.

DENIAL OF REINSTATEMENT; APPEAL.
(a)If the Secretary of State denies a limited cooperative association’s application for reinstatement following administrative dissolution, the Secretary of State shall prepare and file a notice that explains the reason for denial and serve the association with a copy of the notice.
(b)Not later than thirty
(30)days after service of a notice of denial of reinstatement by the Secretary of State, a limited cooperative association may appeal the denial by petitioning the district court to set aside the dissolution. The petition must be served on the Secretary of State and contain a copy of the Secretary of State’s declaration of dissolution, the association’s application for reinstatement, and the Secretary of State’s notice of denial.
(c)The court may summarily order the Secretary of State to reinstate the dissolved cooperative association or may take other action the court considers appropriate. Added by Laws 2009, c. 68, § 114, eff. Jan. 1, 2010.
