§18-441-119. Resignation of agent for service of process.

RESIGNATION OF AGENT FOR SERVICE OF PROCESS.
(a)To resign as an agent for service of process of a limited cooperative association or foreign cooperative, the agent must deliver to the Secretary of State for filing a statement of resignation containing the name of the agent and the name of the association or foreign cooperative.
(b)After receiving a statement of resignation under subsection
(a)of this section, the Secretary of State shall file it and mail or otherwise provide or deliver a copy to the limited cooperative association or foreign cooperative at its principal office.
(c)An agency for service of process of a limited cooperative association or foreign cooperative terminates on the earlier of:
(1)The thirty-first day after the Secretary of State files a statement of resignation under subsection
(b)of this section; or
(2)When a record designating a new agent for service of process is delivered to the Secretary of State for filing on behalf of the association or foreign cooperative and becomes effective. Added by Laws 2009, c. 68, § 19, eff. Jan. 1, 2010.
