(A)Except as provided in division
(B)of this section, whoever violates section 4723.03 , 4723.44 , 4723.653 , or 4723.73 of the Revised Code is guilty of a felony of the fifth degree on a first offense and a felony of the fourth degree on each subsequent offense.
(B)Each of the following is guilty of a minor misdemeanor:
(1)A registered nurse, advanced practice registered nurse, or licensed practical nurse who violates division (A), (B), (C), or
(D)of section 4723.03 of the Revised Code by reason of a license to practice nursing that has lapsed for failure to renew or by practicing nursing after a license has been classified as inactive;
(2)A medication aide who violates section 4723.653 of the Revised Code by reason of a medication aide certificate that has lapsed for failure to renew or by administering medication as a medication aide after a certificate has been classified as inactive.
