Section 4723.072 — Prelicensure nursing education program faculty criteria.

(A)From the effective date of this section through January 31, 2028, a prelicensure nursing education program leading to initial licensure to practice nursing as a licensed practical nurse may use as a member of its faculty any individual who meets either of the following conditions:
(1)Holds a baccalaureate degree in nursing;
(2)Is scheduled to receive a baccalaureate degree in nursing within twelve calendar months after the date the program first uses the individual as a member of its faculty.
(B)(1) During the period specified in division
(A)of this section, the board of nursing shall not refuse to grant full approval to, or renew approval for, a prelicensure nursing education program solely on the basis that the program uses as a member of its faculty an individual described in division
(A)of this section.
(2)On and after February 1, 2028, the board shall not refuse to grant full approval to, or renew approval for, a prelicensure nursing education program solely on the basis that the program uses as a member of its faculty an individual described in division
(A)of this section if the program was approved or applied for approval during the period specified in division
(A)of this section.
(C)Nothing in this section prohibits the board from adopting rules on or after February 1, 2028, to authorize a prelicensure nursing education program to use as a member of its faculty an individual described in division
(A)of this section.
