§ 249. Participating provider pharmacies.

§ 249. Participating provider pharmacies. 1. The state shall offer an
opportunity to participate in this program to all provider pharmacies as
defined in section two hundred forty-one of this title, provided,
however, that the participation of pharmacies registered in the state
pursuant to section sixty-eight hundred eight-b of the education law
shall be limited to state assistance provided under this title for
prescription drugs covered by a program participant's medicare drug
plan.
2. To participate in this program, a pharmacy shall be required to
enter into a provider agreement and shall abide by such terms and
conditions as shall be prescribed in the agreement, including the
release of financial information for the purpose of program audits and
surveys.
