NRS 444.563 Regulations of State Environmental Commission: Activities relating to solid waste management systems. The State Environmental Commission may adopt regulations establishing activities that are related to a solid waste management system. Such regulations may, without limitation, establish places that constitute solid waste management facilities because, as determined by the Commission, the activities performed at the place present a significant hazard to human health, public safety or the environment if solid waste at the place were to be managed improperly.
The determination of the Commission may be based upon, without limitation, the size of the activity, throughput of the activity, location of the place or any other relevant factor determined by the State Environmental Commission.
