NRS 388A.397 Selection of investigator to conduct certain investigations and make determinations or recommendations; petition for order directing charter school to reimburse State Public Charter School Authority for cost of investigation if violation determined to have occurred; authorized actions upon determination of violation of law or breach of terms and conditions of charter contract; order for charter school to suspend operations under certain circumstances.
1. If the State Public Charter School Authority determines that external expertise is necessary to conduct an investigation of a complaint filed pursuant to NRS 388A.395 to 388A.3975 , inclusive, the State Public Charter School Authority may select an investigator to conduct the investigation and make any appropriate determinations or recommendations to the State Public Charter School Authority.
2. If the State Public Charter School Authority determines that a violation has occurred, the State Public Charter School Authority may petition a court of competent jurisdiction for an order directing the charter school to reimburse the State Public Charter School Authority for all or part of the actual costs of its investigation. If the court confirms that a violation has occurred, the court may order the charter school to reimburse the State Public Charter School Authority for all or part of the actual costs of its investigation in an amount the court determines to be reasonable under the circumstances.
A charter school subject to such an order must reimburse the State Public Charter School Authority within 30 days after issuance of the order. Any money received by the State Public Charter School Authority pursuant to this subsection must be used for investigations, audits and other proceedings of the State Public Charter School Authority and does not revert to the State General Fund.
3. If the State Public Charter School Authority determines that a current or former member of the governing body of the charter school or a current or former employee of the charter school failed to cooperate with any investigation conducted pursuant to this section, the State Public Charter School Authority may begin a proceeding to terminate the charter contract of the charter school pursuant to NRS 388A.330 .
4. If the State Public Charter School Authority determines that the charter school or an employee of the charter school has violated any provision of this chapter or another statute or regulation applicable to charter schools or has materially breached the terms and conditions of the charter contract of the charter school, the State Public Charter School Authority may:
(a)Begin a proceeding to terminate the charter contract of the charter school pursuant to NRS 388A.330 ; and
(b)Refer the matter to the district attorney of the county in which the charter school is located, the Attorney General or any other appropriate agency for further action.
5. If the State Public Charter School Authority determines that the current operations of the charter school pose an imminent danger to the health and safety of the pupils or staff of the charter school, the State Public Charter School Authority shall order the charter school to suspend its operations at any or all of its facilities until appropriate corrective action has been taken.
