1. As used in this act:
“CDC PEP guidelines” means the “Updated Guidelines for Antiretroviral Postexposure Prophylaxis After Sexual, Injection Drug Use, or Other Nonoccupational Exposure to HIV – United States, 2016,” or any subsequent guidelines.
“CDC PrEP guidelines” means the “ Preexposure Prophylaxis for the Prevention of HIV Infection in the United States – 2021 Update: A Clinical Practice Guideline,” or any subsequent guidelines.
“HIV” means the human immunodeficiency virus.
“HIV preexposure prophylaxis” means any drug or drug combination authorized or approved by the United States Food and Drug Administration for the prevention of HIV that meets the clinical recommendations, and that is furnished according to the standards of care, provided in the CDC PrEP guidelines or any subsequent guidelines.
“HIV postexposure prophylaxis” means any drug or drug combination authorized or approved by the United States Food and Drug Administration that meets the clinical recommendations for HIV postexposure prophylaxis, and that is furnished according to the standards of care, provided in the CDC PEP guidelines or any subsequent guidelines.
“Standards of care” means the care of a pharmacist ordering and providing HIV preexposure prophylaxis or HIV postexposure prophylaxis services as determined by the circumstances that present in practice, which care meets the same standard of care provided by other qualified health care professional in the same or similar setting.
