43:5A-1. Definitions

For the purposes of this act:
a. "final compensation" means either
(1)the average annual compensation of an employee during the last 60 months preceding the month in which the employee is retired, or
(2)the average annual compensation of the employee for any 5 fiscal years of the State during the period of continuous service upon which his eligibility for a pension under this act is based, depending upon which method of computation provides the larger benefit to the employee;
b. "years of continuous service" shall be computed as the number of years and months of paid service rendered to the State of New Jersey;
c. an employee shall be deemed to be "permanently and totally disabled" when it appears not only that he is physically or otherwise incapacitated for service, but also that such incapacity will, in all reasonable probability, continue permanently;
d. the Social Security system shall not be deemed a retirement system for the purpose of determining eligibility to a pension under this act;
e. "Commission" means the State House Commission.
