34:6-136.12. Conditions of manufacture

Industrial home work shall be performed:
(1)Only by a person possessing a valid home worker's certificate, and resident in the home in which the work is done;
(2)Only by persons 16 years of age or over;
(3)Only in accordance with the wages, hours or working conditions established for labor in factories or businesses by persons of the same age as the home workers by State law or regulation or any applicable Federal law or regulation;
(4)Only in accordance with the provisions of any State law or regulation, including the provisions of this act, or of any applicable Federal law or regulation, relating to employment and applicable to home workers; and
(5)Only in a home that is clean and sanitary and free from any infectious, contagious or communicable disease.
Every employer shall be deemed to have accepted responsibility for the observance of the conditions of manufacture specified by this section and of such terms and conditions as may be specified pursuant to section 6 of this act; and each of such conditions shall be deemed to be a condition of the employer's permit to the same extent as though it were expressly set forth therein.
