10. Decertification; Cannabis Employees
The Division of Private Employment Dispute Settlement shall decertify a labor organization representing cannabis employees if either of the following occur:
a. The Division of Civil Rights Department finds that the labor organization engaged in discrimination on any basis listed in the “Law Against Discrimination,” P.L.1945, c.169 (C.10:5-1 et seq.).
b. The United States Equal Employment Opportunity Commission finds, pursuant to 42 U.S.C. s.2000e-5, that the labor organization engaged in discrimination on the basis of race, color, national origin, religion, sex, or any other arbitrary or invidious classification in violation of Subchapter VI of Chapter 21 of Title 42 of the United States Code during the period of the labor organization’s present certification.
