4. a. Upon the merger of New Jersey City University and Kean University, and the receipt of any required notifications and prior approvals from the State or federal authorities and any applicable accrediting bodies, all of the functions, powers, duties, and rights of New Jersey City University shall be transferred and assigned to Kean University. All of New Jersey City University’s rights, title, and interest in its colleges, schools, institutes, and centers, its auxiliary and supporting institutions and the campuses located in Jersey City, New Jersey, including, but not limited to, all associated fixed tangible assets, real property, building and all furniture, fixtures, equipment, and personal property contained therein, shall be transferred to Kean University and shall be devoted to the purposes of public higher education in the State in accordance with the terms of any gift, grant, trust, contract, or other agreement with the State or any of its political subdivisions or with the United States or with any public body, department, or any agency of the State or the United States or with any individual, firm, or corporation.
Any transfer of property owned by the New Jersey Educational Facilities Authority to Kean University shall be in accordance with subsection
(g)of N.J.S.18A:72A-5.
b. Upon the merger of New Jersey City University and Kean University, and the receipt of any required notifications and prior approvals from the State or federal authorities and any applicable accrediting bodies, thereafter, if in any law, rule, regulation, order, contract, document, judicial or administrative proceeding or otherwise, reference is made to New Jersey City University, the same shall mean and refer to Kean University to the extent permitted by applicable law.
c. The provisions of this section shall be effectuated immediately upon the closing of the acquisition of New Jersey City University by Kean University and shall require no additional action on the part of Kean University.
