11. The department shall, no later than in time for plan year 2025 and immediately upon filing with the Office of Administrative Law, adopt rules and regulations, notwithstanding the provisions of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to the contrary, requiring no additional limitations on copayments, coinsurance, or deductibles for small employer health benefits plans pursuant to P.L.1992, c.162 (C.17B:27A-17 et seq.) beyond those set forth in the federal Patient Protection and Affordable Care Act, Pub.L.111-148, as amended by the federal "Health Care and Education Reconciliation Act of 2010," Pub.L.111-152 for plans issued pursuant to P.L.1992, c.161 (C.17B:27A-2 et seq.).
The rules and regulations adopted pursuant to this section shall be in effect only for plan year 2025. Rules and regulations shall thereafter be adopted, amended, or readopted for plan years 2026 and thereafter by the department in accordance with the requirements of section 4 of P.L.1992, c.162 (C.17B:27A-20) and the requirements of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).
