Part 2. Criminal History Record Checks.
§ 143B-1209.09. Definition; authority to use third-party vendor.
(a)Definition. - For purposes of this Part, the term "Bureau" means the State Bureau of Investigation.
(b)Authority. - The Bureau may contract with any third-party vendor approved by the Director of the Bureau for
(i)fingerprinting,
(ii)conducting any criminal record check the Bureau is authorized to provide by law, or
(iii)fingerprinting and conducting any criminal record check the Bureau is authorized to provide by law. Notwithstanding any provision of law to the contrary, any third-party vendor who contracts with the Bureau under the authority set forth in this subsection may charge a fee for each service provided. Any restrictions or requirements set by law governing fingerprints and other information collected by the Bureau for a criminal record check apply to a third-party vendor used by the Bureau pursuant to this subsection.
