85-15-212 . Operating permit.
(1)An operation plan must be prepared by the owner and approved by the department prior to operation of the high-hazard dam or reservoir. The operation plan must set forth at a minimum:
(a)a reservoir operation procedure;
(b)a maintenance procedure for the high-hazard dam and appurtenant works; and
(c)emergency procedures and warning plans.
(2)When construction is complete and if the high-hazard dam or reservoir conforms to the construction permit and when an operation plan has been approved, the department shall issue a permit to operate the high-hazard dam or reservoir, containing conditions on the safe operation of the high-hazard dam as it considers necessary.
