72-15-103 . Requirement to procure letters of administration -- bond and oath.
(1)Whenever a public administrator takes charge of an estate under order of the court, the administrator shall with all convenient dispatch procure letters of administration on the estate in the same manner and under the same proceedings as letters of administration are issued to other persons.
(2)The public administrator's official bond and oath are in lieu of a personal representative's bond and oath, but when real estate is ordered to be sold, another bond may be required by the court.
