2-1-605 . Penalties -- exemptions.
(1)In addition to any other penalties or remedies provided by law and except as provided in subsection (3), a state agency or local government that violates the provisions of 2-1-602 shall be punished by a fine of $10,000 every 5 days that the state agency or local government is not in compliance with the provisions of 2-1-602 .
(2)Except as provided in subsection (3), a local government that is in violation of 2-1-602 may not:
(a)receive new grants awarded under the provisions of Title 90, chapter 6, part 2; or
(b)have projects prioritized or recommended by the department of commerce for infrastructure projects under the provisions of Title 90, chapter 6, part 7.
(3)A state agency or local government may not be penalized under this section if the state or local government comes into compliance with the provisions of this part within 14 days after the filing of an action under 2-1-604 .
(4)A fine collected pursuant to this section must be deposited in the state general fund.
