27.10 PERISHABLE FARM PRODUCTS EXAMINATION.
(a)When perishable farm products are shipped to or received by a farm products dealer for handling, purchase, or sale in this state, and the farm products dealer finds the perishable farm products to be in a spoiled, damaged, unmarketable, or unsatisfactory condition, the dealer must have the perishable farm products examined by an inspector assigned by the commissioner for that purpose. The inspector must execute and deliver a certificate to the farm products dealer stating the day, the time and place of the inspection, and the condition of the perishable farm products and mail or deliver a copy of the certificate to the shipper of the perishable farm products.
(b)This section does not apply when the parties to the perishable farm products sales contract waive the inspection requirement.
