324.11720 Temporary variance from act.
Sec. 11720.
(1)The director may grant a temporary variance from a requirement of this part added by the 2004 amendatory act that amended this part if all of the following requirements are met:
(a)The variance is requested in writing.
(b)The requirements of this part cannot otherwise be met.
(c)The variance will not create or increase the potential for a health hazard, nuisance condition, or pollution of surface water or groundwater.
(d)The activity or condition for which the variance is proposed will not violate any other part of this act.
(2)A variance granted under subsection
(1)shall be in writing and shall be posted on the department's website.
