§19–3B–09.
(a)A person who violates any provision of this subtitle or any regulation adopted under this subtitle is guilty of a misdemeanor and on conviction is subject to a penalty not exceeding $1,000 or imprisonment not exceeding 1 year or both. Each day a violation is continued after the first conviction is a separate offense.
(1)In addition to the provisions of subsection
(a)of this section, the Secretary may impose an administrative penalty of up to $1,000 for a violation of any provision of this subtitle or any regulations adopted under this subtitle.
(2)The Secretary shall adopt regulations to provide standards for the imposition of an administrative penalty under paragraph
(1)of this subsection.
